1. Scope of This Policy
This Privacy Policy describes how Zhenin LLC, doing business as 2bizy Business Solutions ("2bizy," "we," "us"), collects, uses, and shares information in connection with our AI phone receptionist and web chat service (the "Service"). It covers two kinds of information: information about the businesses that subscribe to the Service ("Customers") and information about the individuals who call or message a Customer through the Service ("Callers" or "end users").
2. Our Roles
For Customer account information, such as billing and account contact details, 2bizy acts as the business responsible for that data. For Caller and end-user information collected while operating the Service on a Customer's behalf, such as call recordings, transcripts, and chat logs, 2bizy acts as a service provider or processor to the Customer, consistent with Appendix A (Data Processing Addendum) of the Terms of Service. The Customer determines how the Service is configured and is the business responsible for its own callers and end users under applicable law.
3. Information We Collect
Customer account data: name, business name, email, phone number, industry configuration, and account settings. Payment card data is collected and held directly by Stripe; 2bizy does not store full card numbers.
Caller and end-user data, collected on behalf of Customers: call audio recordings, call transcripts, AI-generated call summaries, caller name and phone number, appointment and scheduling details, lead records, and web chat messages logged per session.
Usage and technical data: basic logs needed to operate, secure, and troubleshoot the Service.
4. Sources of Information
We collect information directly from Customers during signup and account use, directly from Callers and chat users during calls and chat sessions, and automatically through the operation of the Service (for example, call metadata generated when a call is placed).
5. How We Use Information
We use information to: provide and operate the Service, including answering calls and chats and generating transcripts, summaries, and lead records; send Customers notifications about calls, messages, and appointments by email or SMS; process payments through Stripe; provide customer support; secure the Service against fraud and abuse; and improve the Service, including through aggregated, de-identified usage statistics that do not identify a Customer or Caller.
We use Customer call recordings, transcripts, chat logs, agent outputs, corrections, and interaction data to configure, evaluate, test, tune, correct, personalize, and improve the AI agents serving that Customer's account. This may include automated analysis and review by authorized personnel.
We may also internally review and analyze such data for quality assurance and to identify errors, performance issues, security concerns, and opportunities to improve the Service and the performance of 2bizy AI agents. Improvements, techniques, prompts, workflows, error patterns, evaluation methods, and other general learnings derived from this work may be applied across the Service. We do not disclose one Customer's identifiable Customer Data to another Customer or use Customer-specific personal information to perform services on behalf of another Customer.
We do not permit Customer Data to be used by us or our third-party model providers to train general-purpose foundation models. This restriction does not prevent the account-specific tuning, quality assurance, evaluation, testing, correction, prompt or workflow optimization, or improvement of 2bizy's AI agents and other Service components described above.
Additional restrictions apply to Protected Health Information and other regulated data processed through an account configured for 2bizy's Healthcare/HIPAA Mode, as described in the applicable Healthcare Addendum and Business Associate Agreement.
6. Health Information and HIPAA
The Service is not intended to process Protected Health Information ("PHI") unless Customer's account has been activated for 2bizy's Healthcare/HIPAA Mode under a signed Business Associate Agreement. A Business Associate Agreement is available for eligible healthcare customers upon request. Customer must not submit PHI to the Service before Healthcare Mode is activated. Where Healthcare Mode is active, the Business Associate Agreement and applicable Healthcare Addendum govern our use and disclosure of PHI and control over any conflicting provision of this Policy. We do not represent that the Service is HIPAA compliant or HIPAA certified as a general matter.
7. Subprocessors and Third-Party Service Providers
We use the following categories of service providers to operate the Service. Each processes information only as needed to perform its function for us.
- Retell AI: voice conversation orchestration for AI phone calls.
- ElevenLabs: speech synthesis (text-to-speech) for the AI voice.
- Telnyx: telephony and SMS carrier services, including call routing and number provisioning.
- OpenAI: language model processing used to understand and respond to calls and chats.
- Stripe: payment processing; card data is held by Stripe and is not stored by us.
- Google Workspace: internal email and spreadsheet operations.
- Managed VPS hosting infrastructure used to run the Service.
We enter into agreements with these providers that require them to protect information and use it only to provide services to us. The then-current subprocessor list is available on request at support@2bizy.com.
8. No Sale of Personal Information
We do not sell personal information, and we do not share personal information for cross-context behavioral advertising, as those terms are defined under California law.
9. California and Other State Privacy Rights
For Customer account data, 2bizy acts as the business. California residents (and residents of other states with similar laws) may have the right to request access to, correction of, or deletion of their personal information, and the right to opt out of certain data uses, subject to applicable exceptions. To exercise these rights, contact us at support@2bizy.com.
For Caller and end-user data collected while operating the Service for a Customer, 2bizy acts as a service provider or processor under the California Consumer Privacy Act and similar state laws, consistent with Appendix A (Data Processing Addendum) of the Terms of Service. Callers and end users who wish to exercise privacy rights regarding their interactions with a specific business should contact that business directly. We will assist our Customers in responding to verified requests as required by applicable law.
10. Data Retention
We retain Customer account data and Caller/end-user data for as long as the Customer's account is active, in order to provide the Service. After an account is closed, or upon a valid deletion request, we delete or de-identify the associated data within a reasonable period, except where retention is required to comply with legal, tax, accounting, or dispute-resolution obligations.
11. Cookies and Similar Technologies
Our website uses a minimal set of cookies and similar technologies necessary for account login, security, and basic site functionality. We do not use cookies for third-party advertising.
12. Children's Privacy
The Service is not directed to individuals under the age of 16, and we do not knowingly collect personal information from children under 16. If we learn that we have collected such information, we will take steps to delete it.
13. Security
We use reasonable administrative, technical, and physical safeguards designed to protect information within our control from unauthorized access, use, or disclosure. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
14. Changes to This Policy
We may update this Privacy Policy from time to time. Material changes will be communicated by email or through a notice on our website. The "Effective Date" at the top of this policy reflects the most recent update.
